Frequently Asked Questions

Below is information relating to some of the common ways in which a Notaries services are required. Click on one of the links below to jump to that section.

What is Notarisation?

A notary, or notary public, is a public official who plays a crucial role in the legal system by performing various duties to help ensure the authenticity and integrity of important documents.

The primary function of a notary is to witness the signing of documents, which helps prevent fraud and guarantees that the signatures are genuine. This process involves verifying the identity of the signers, ensuring they understand the contents of the document, and confirming that they are signing the document voluntarily and without any undue pressure.

Notarization is a formal process where a notary certifies a document, typically by attaching a notarial certificate to it. This notarial certificate includes statements of fact or law related to the document being certified. It serves as an official declaration that the notary has completed the required steps to verify the authenticity of the document and the identities of the parties involved. The certificate helps provide legal assurance that the document has been handled properly and that all necessary formalities have been observed.

In practice, our notaries often issue these certificates in the language of the country where the document is intended to be used. This ensures that the certification aligns with the specific legal and procedural requirements of that jurisdiction, facilitating smoother acceptance and processing of the document abroad.

Beyond witnessing signatures, notaries have several other functions. They can administer oaths and affirmations, take affidavits and depositions, and certify copies of documents. The exact roles and responsibilities of notaries can vary depending on local laws and regulations. Overall, a notary’s role is to provide an impartial, trustworthy service that upholds the integrity of legal transactions and documentation. By performing these duties, notaries help to safeguard the legal process and ensure that documents are executed in accordance with the law.

What is a signing agent?

A  signing agent is a public notary who is expert in loan closing documents. A lender, title company, or escrow service may hire a signing agent to handle getting documents delivered, signed, or processed efficiently and on time.

Do I need an appointment?

Whether or not you need an appointment depends on your specific needs and the timing of our services. If you plan to visit our Mississauga office, we welcome walk-ins from 9 AM to 5 PM, so no appointment is necessary during those hours. However, if you need our services outside of these hours, or if you prefer us to come to a different location such as your home, office, a restaurant, a nursing home, hospital, or a correctional facility, we do require that you schedule an appointment in advance. This helps us ensure that we can accommodate your request efficiently and provide you with the high level of service you deserve.

Please let us know your preferences, and we will work with you to arrange a convenient time and location.

Why do I need to bring proof of identity and proof of address?

When you visit a notary, it is essential to bring proof of identity and proof of address for several important reasons:

  1. Verification of Identity: The notary needs to confirm that you are who you claim to be. By providing valid proof of identity, such as a government-issued ID (e.g., passport, driver’s license), the notary can verify your identity and ensure that you are legally authorized to sign the documents.
  2. Prevention of Fraud: Proof of identity helps prevent fraud by ensuring that the signers of the document are legitimate and that the transaction is genuine. This helps maintain the integrity of the notarization process and protects all parties involved.
  3. Confirmation of Address: Proof of address, such as a recent utility bill or bank statement, helps the notary confirm your current residence. This can be particularly important for documents that require your address as part of the notarization process or for legal reasons.
  4. Compliance with Legal Requirements: Many jurisdictions have specific legal requirements for notarizations, including the need to verify identity and address. Providing these documents ensures that the notarization complies with local laws and regulations.

By presenting both proof of identity and proof of address, you help the notary perform their duties accurately and effectively, thereby ensuring that the notarization is valid and legally binding.

How much will it cost?

This will depend on the document being certified and exactly what the notary is required to do. Our notaries will be happy to discuss this with you prior to your appointment (please note it will often be necessary to see the document in advance in order to provide an accurate fee estimate).
